RALEIGH, N.C. (AP) - North Carolina’s second-highest court has reversed a decision requiring a man who pleaded guilty to taking indecent liberties with a child to wear a monitoring system for the rest of his life.
The state Court of Appeals ruled Tuesday that Kevin James Gambrell was incorrectly sentenced to wear a satellite-based monitoring system for his lifetime. The three-judge panel said prosecutors didn’t prove that a monitoring system was a reasonable way to prevent Gambrell from reoffending.
The unanimous ruling says prosecutors must provide evidence such as expert testimony when a judge determines the use of monitoring systems.
Gambrell was sentenced in January 2018 in Iredell County to up to 30 months in prison. He had been convicted a decade earlier in Alexander County of using a computer to solicit a child.
