Prosecutors said they hadn’t decided whether to upgrade the charges after Lowndes died.

According to an arrest warrant affidavit, Mallin told police Lowndes was holding a .22-caliber rifle and it fired as he tried take it away.

Online jail records didn’t indicate whether Mallin had a lawyer, and no phone number could be found for him.
