JOHNSTOWN, N.Y. (AP) - A 33-year-old upstate New York police officer has resigned and will spend one year in jail after pleading guilty to rape.

Adam Schwabrow of Johnstown was sentenced Tuesday in Fulton County Court in a plea deal. He admitted having sexual intercourse with someone less than 17 years of age in May of 2011.

Schwabrow was not on duty at the time he committed the crime, and authorities say at no time was force alleged in the case. His resignation from the Johnstown Police Department took effect March 4.

The Saratoga County District Attorney’s Office ordered Schwabrow to surrender any firearms when he was arrested last September, and said he complied.

Assistant District Attorney Jennifer Buckley prosecuted the case and says the victim is relieved it’s over.
