BUFFALO, N.Y. (AP) - New York state investigators say a Buffalo police officer did not break the law when he fatally shot an unarmed suspect last May.
The attorney general’s office released a detailed report on its investigation Thursday. It calls the death of Jose Hernandez Rossy “the result of a calamitous confluence of events,” but finds no fault on the part of the officer.
Under the law, police are allowed to use deadly force against a fleeing suspect if an officer believes the suspect has just committed a violent crime or is armed. In this case, Officer Justin Tedesco mistakenly believed Hernandez Rossy had shot his partner during a struggle inside Hernandez Rossy’s vehicle.

Attorney General Eric Schneiderman says the findings are based on eyewitness accounts and video and other evidence.
