A Los Angeles Superior Court judge allowed Halle Berry’s 13-year-old son, Maceo, to testify in her custody dispute with ex-husband Olivier Martinez, according to court documents obtained by TMZ.

Maceo’s testimony will be related to Mr. Martinez’s request for a restraining order and will be heard in a closed courtroom with only the parties, counsel and court personnel present.

Mr. Martinez accused Ms. Berry of jumping on the boy, putting her hands around his neck and choking him while he was playing a virtual reality game.

TMZ reported the alleged Sept. 26 altercation took place at Ms. Berry’s home, but she denies hurting her son and has tried to keep him from testifying, arguing that Mr. Martinez coached him on what to say.

A judge granted Mr. Martinez a temporary restraining order on Oct. 1, ordering Ms. Berry to stay 100 yards from him.

The order allowed Ms. Berry unsupervised daytime visits while the couple’s August 2023 custody agreement remains in place.

She can see Maceo Mondays and Tuesdays and every other weekend, from 10 a.m. to 8 p.m.

ARY News reported that Mr. Martinez temporarily holds primary physical custody of Maceo in his Los Angeles home pending a hearing on Friday.

Mr. Martinez is seeking sole custody, while Ms. Berry is asking the court to restore their 50-50 arrangement.
