PROVIDENCE, R.I. (AP) - A judge won’t toss a murder indictment after two mistrials in the case against a Rhode Island man accused of killing his girlfriend.
The Superior Court judge on Friday refused to dismiss the indictment against Andrew Jett. She rejected the defense’s claim that prosecutors intentionally failed to disclose information. The judge ordered a new trial.
A judge declared a mistrial this month in Jett’s case, citing “multiple discovery violations by the prosecution” that affected the fairness of the trial. A mistrial was declared last month after a witness made a disclosure about facts the jurors weren’t supposed to hear.
Jett is charged with killing 50-year-old Michelle Busby at her apartment in 2012.
He previously pleaded no contest to second-degree murder in the 1992 death of his then-girlfriend, Stephanie Oxendine.
