OPINION:
To stop birthright citizenship, the Republicans seem to be considering an effort to pass a law in Congress. But that is not the answer.
First, such a bill would not clear the Senate. Second, if a miracle occurs and it does pass, it will take an inordinate amount of time for it to be effective. Third, the Supreme Court may also declare such a law unconstitutional.
The high court will not allow Congress to define the 14th Amendment’s words, “Subject to the Jurisdiction thereof.” Only an amendment to the Constitution will allow such an interpretation. It would be very difficult, if not impossible, to pass such an amendment.
Instead, President Trump should immediately issue an executive order banning foreign pregnant women from visiting the United states. The EO should also provide that only a child born to foreign parents in our country has a right to stay here as a citizen. The child should be sent back to his country of origin, returned to his parents, upon their request, or be placed in the care of a citizen relative or foster home in the United States.
There is no rationale for the “anchor baby” routine and it must stop.
The Supreme Court recently gave President Trump vast executive authority in one of its rulings. He should have the power to do what is necessary protect our nation.
